You represent that You are over the age of 18. The Company does not permit those under 18 to use the Service.

Placing Orders for Goods
By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct, and complete.
By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.

We reserve the right to refuse or cancel Your Order at any time for any reason, including but not limited to:

We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.
Availability, Errors and Inaccuracies
We are constantly updating Our offerings of Goods on the Service. The Goods available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods on the Service and in Our advertising on other websites.
We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Prices Policy
The Company reserves the right to revise its prices at any time prior to accepting an Order.
The prices quoted may be revised by the Company subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges, higher foreign exchange costs and any other matter beyond the control of the Company. In that event, You will have the right to cancel Your Order.
Payments
All Goods purchased are subject to a one-time payment. Payment can be made through various payment methods, as are available at the given time, as provided for on the Website, such as Visa, MasterCard, Affinity Card, American Express cards, or online payment methods (PayPal, for example).
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.
Shipping
Orders are normally processed and shipped within four (4) business days. The Company may provide shipping via USPS, UPS, FEDEX, or other providers, as determined at the Company’s discretion.
All shipment fees incurring from refused Goods shall be paid by You and will not be chargeable to the Company.
The Company will automatically insure all orders of Goods up to $1,000 USD (one thousand dollars).
Due to the nature of shipping insurance, the Company will not be held responsible for any misdelivery of or theft of delivered Goods.
All reports of lost, damaged, or incorrect Goods must be made to the Company via email (to magimercantile@outlook.com) and must include: order number, full contact information (including name, email address, and phone number), and specific details.
For any damaged Goods, please provide detailed photographs of the package and the Goods in question in the email.
For damaged Goods, DO NOT discard any packaging or associated packing materials. The original box and packaging must be kept until the carrier/shipper responsible for delivery claims them unnecessary for any claim purpose.
Any damaged or incorrect Goods must be reported within three (3) days of receipt. If not reported within three (3) days of receipt, we will consider all claims of damage, defect, or other error waived.
Determination and compensation of loss, damage, or misorder of Goods will be at the Company’s sole discretion.
Returns
Requests for return must be made to the Company within three (3) days of receipt of Goods.
Requests must be made via email (to magimercantile@outlook.com) and must include: order number, full contact information (including name, email address, and phone number), and specific details.
No requests for return will be considered after three (3) days from the date of receipt of Goods by You. No returns will be considered for buyer’s remorse.
Determinations of returns will be at the Company’s sole discretion.
All returned Goods must be in unaltered and unused condition and must include a copy of the original invoice or original invoice order number. Returned Goods received back to the Company in abused or altered condition will not be refunded and will be returned back to You at Your expense.
Returned Goods will be reimbursed to You (less the original shipping cost) no later than fourteen (14) days from the day on which the Goods are received back to the Company.
User Accounts
When You create an Account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your Account on Our Service.
You acknowledge and agree that You control access to Your Account. Your Account may only be used by You or by third parties with Your express written consent. The Company will not be held responsible or liable for any unauthorized access to Your Account, and You are under a continuing duty to promptly provide the Company with notice of any unauthorized or unusual access to Your Account. You are advised to keep the username and password associated with Your Account secure and secret. By creating an Account and providing Your personal information to the Company, You acknowledge and agree that the Company may use Your personal information to contact You.
The Company reserves the right to suspend or terminate Your Account at any time and in its sole and absolute discretion, including, but not limited to, for a violation of any term or condition of these Terms.
Intellectual Property
The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors.
The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.
Links to Other Websites
Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.
Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.
Disclaimer of Warranties and Limitation of Liability

Indemnification

Your obligation to defend the Company will not provide You with the ability to control the Company’s defense, and the Company reserves the right to control its defense, including its choice of counsel and whether to litigate or settle a claim subject to indemnification.
Choice of Law and Stipulation to Jurisdiction
You and the Company agree that any dispute arising out of or related to these Terms or Your use of the Website, including, but not limited to, Your purchase or use of goods from or through the Website, will be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. Specifically, the validity, interpretation, and performance of these Terms will not be governed by the United Nations Convention on the International Sale of Goods. Except for claims for injunctive relief by either party, You and the Company agree that any dispute or controversy arising out of, in relation to, or in connection with these Terms or Your use of the Website including, without limitation, any and all disputes, claims (whether in tort, contract, statutory, or otherwise) or disagreements concerning the existence, breach, interpretation, application or termination of these Terms, will be resolved by final and binding arbitration pursuant to the Federal Arbitration Act in Reading, Pennsylvania or, at the option of the party seeking relief, by telephone, online, or via written submissions alone, and be administered by the American Arbitration Association (“AAA”) under the then in force Commercial Arbitration Rules by one arbitrator appointed in accordance with such rules. Such arbitration will be independent and impartial. If the parties fail to agree on the arbitrator within twenty (20) calendar days after the initiation of the arbitration hereunder, AAA will appoint the arbitrator.
This arbitration will be conducted in the English language. The decision of the arbitrator will be final and binding on the parties and judgment on any award(s) rendered by the arbitrator may be entered in any court having jurisdiction thereof. Nothing in this section will prevent either party from seeking immediate injunctive relief from any court of competent jurisdiction, and any such request shall not be deemed incompatible with the agreement to arbitrate or a waiver of the right to arbitrate. The parties undertake to keep confidential all awards in their arbitration, together with all confidential information, all materials in the proceedings created for the purpose of the arbitration and all other documents produced by the other party in the proceedings and not otherwise in the public domain, save and to the extent that disclosure may be required of a party by legal duty, to protect or pursue a legal right or to enforce or challenge an award in legal proceedings before a court or other judicial authority. The arbitrator shall award all fees and expenses, including reasonable attorney’s fees, to the prevailing party. Any judgment rendered by the arbitrator may be entered in any court of competent jurisdiction.
ANY DISPUTE RESOLUTION PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE PURCHASE OR USE OF GOODS FROM OR THROUGH THE WEBSITE, WHETHER IN ARBITRATION OR OTHERWISE, SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION, AND YOU AND THE COMPANY EXPRESSLY AGREE THAT CLASS ACTION AND REPRESENTATIVE ACTION PROCEDURES SHALL NOT BE ASSERTED IN NOR APPLY TO ANY ARBITRATION PURSUANT TO THESE TERMS.
Any claims must be brought within one year of each applicable invoice or will otherwise be barred.
United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised Terms. If You do not agree to the new terms, in whole or in part, please stop using the Website and the Service.
